Terms of Use

1. General Provisions
These Terms of Use (hereinafter referred to as the "Terms") govern the relationship between the user (hereinafter referred to as the "User") and the administration of the Bayge CRM service (hereinafter referred to as the "Service"), available at crm.bayge.kz.
Registration and use of the Service constitutes the User's full and unconditional acceptance of these Terms. If you do not agree with any provisions, do not use the Service.
2. Service Description
Bayge CRM is a cloud-based customer relationship management (CRM) platform providing tools for:
- Omnichannel customer communication (WhatsApp, Telegram, Instagram, Email).
- Contact and company management.
- Sales pipeline and deal management.
- Task assignment and progress tracking.
- Analytics and reporting.
- Team collaboration with role-based access control.
3. Registration and Account
- Use of the Service requires registration with accurate information.
- Registration is available via email/password or through Google sign-in (OAuth 2.0).
- The User is responsible for the security of their account credentials.
- A single user may belong to multiple organizations (tenants) within the Service.
- The Administration reserves the right to block an account for violation of these Terms.
4. Pricing Plans and Payment
The Service offers several pricing plans with different features and limitations. Basic functionality is available free of charge during the trial period (14 days).
- Paid plan pricing is listed on the pricing page in Kazakhstani tenge (KZT) and US dollars (USD).
- Payment is made monthly or annually depending on the chosen plan.
- The Administration reserves the right to change pricing with at least 30 days' notice to users.
5. User Rights and Obligations
The User has the right to:
- Use all features of the Service within the selected pricing plan.
- Export their data at any time.
- Delete their account and data by contacting support.
The User agrees to:
- Provide accurate information during registration.
- Not use the Service for illegal purposes, spamming, or distributing malicious software.
- Not attempt unauthorized access to other users' data.
- Not disrupt the Service's operation (DDoS attacks, scraping, reverse engineering).
- Comply with the laws of the Republic of Kazakhstan when using the Service.
6. Administration Rights and Obligations
The Administration agrees to:
- Ensure the Service's operability and protect user data.
- Promptly inform users of significant changes to the Service.
- Provide technical support to users.
The Administration reserves the right to:
- Perform maintenance with temporary access restrictions to the Service.
- Modify the Service's functionality without prior notice.
- Block accounts that violate these Terms.
7. Intellectual Property
All rights to the Service, its design, code, trademarks, and content belong to the Bayge CRM administration. The User retains all rights to their data uploaded to the Service.
8. AI Chatbots
- Chatbot responses are generated using artificial intelligence technologies and may contain inaccuracies.
- The Administration is not responsible for the content of AI responses. The User independently configures the system prompt and knowledge base for the bot.
- Customer personal data is anonymized before being transmitted to the AI provider.
- The User agrees not to use chatbots for spamming, fraud, or misleading purposes.
9. Communication Channels
- The User is responsible for compliance with platform rules (WhatsApp, Telegram, Instagram) when using communication channels.
- The Administration is not responsible for messenger account blocks resulting from platform rule violations.
10. Limitation of Liability
- The Service is provided "as is." The Administration does not guarantee uninterrupted operation.
- The Administration is not liable for losses arising from the use or inability to use the Service.
- The User is solely responsible for the security of their data and is advised to create regular backups.
11. Confidentiality
Personal data processing is carried out in accordance with the Privacy Policy, which is an integral part of these Terms.
12. Dispute Resolution
All disputes arising in connection with the use of the Service shall be resolved through negotiation. If an agreement cannot be reached, disputes shall be settled in accordance with the laws of the Republic of Kazakhstan.
13. Changes to the Terms
The Administration reserves the right to amend these Terms. The current version is always available on this page. Continued use of the Service after changes to the Terms constitutes acceptance of the updated version.
